Terms of Service

Effective 13 October 2026 · Version 2026-10-17

The short version

  • Mailpitcher is an email client with outreach tools. It connects to mailboxes you own or are allowed to use, and sends only when you tell it to.
  • You are responsible for what you send and who you send it to. No spam: the Acceptable Use Policy is part of these terms.
  • Paid plans renew automatically until you cancel, and we remind you before each renewal. Cancel online in Settings → Plan, in a couple of clicks; you keep access until the period ends. A new subscription can be withdrawn within 14 days, by anyone: the plan ends at once and you get back the unused part.
  • The $1.99 trial is 3 days of everything in Pro with lower limits, once per customer; it becomes the monthly plan you choose, Solo ($7.99 a month) or Pro ($12.99 a month), unless you cancel before it ends.
  • You can get a copy of your data and ask us to delete your account at any time.

This summary helps you read the terms; it doesn't replace them.

1. Who we are and what these terms cover

Mailpitcher (the "Service") is provided by [COMPANY NAME], registration number [REGISTRATION NUMBER], [REGISTERED ADDRESS], Latvia ("we", "us"). These Terms of Service, together with the Acceptable Use Policy, the Privacy Policy and the Data Processing Addendum, form the agreement between us and you, the person or organisation using the Service ("you").

You accept these terms when you create an account or tick the box asking you to. If you accept on behalf of an organisation, you confirm you have authority to bind it, and "you" means that organisation.

The Service is for professional and business use. You must be at least 18 years old. If you use it as a consumer, the mandatory consumer protections of the country you live in still apply, and nothing in these terms limits them.

2. What the Service does

Mailpitcher lets you read and send email from mailboxes you connect (for example Gmail, Outlook or any IMAP/SMTP host), run outreach campaigns with personalised messages and follow-ups, and organise outreach in projects. Depending on your plan, it also offers an API for AI assistants (the "MCP server").

To do this, the Service connects to your mail provider with the credentials or authorisation you give it (an app password or a provider sign-in), keeps a working copy of your mail so you can search and read it, and sends messages through your provider when you, or a campaign or tool you set up, ask it to. It does not send anything on its own initiative.

We may improve, change or remove features. If a change takes away something material you pay for, we'll tell you in advance and you may cancel and receive a pro-rata refund for the unused period.

3. Your account

  • Give a real email address you control; sign-in links and security notices go there.
  • Keep your account secure. Some features (connecting real mailboxes, sending, API tokens) require two-step sign-in. Don't share your account or tokens; an API token acts as you.
  • Tell us promptly at hello@mailpitcher.com if you think your account has been misused.
  • You're responsible for activity in your account, including activity by AI tools or people you give access to.

4. Connecting mailboxes

  • Only connect mailboxes you own, or that you are authorised to use for the purpose you use them for. By connecting one, you instruct us to access it on your behalf to provide the Service.
  • Your mail provider's own terms and limits still apply (for example Google's and Microsoft's sending limits). Providers may limit, flag or suspend a mailbox for reasons outside our control, including how it's used. We aren't responsible for a provider's decisions, but our daily caps and pacing exist to help you stay inside safe limits.
  • You can disconnect a mailbox at any time. Disconnecting deletes the stored credentials and the synced copy of that mailbox from our systems; mail on your provider is not touched.

5. Acceptable use and sending

You agree to follow the Acceptable Use Policy. In particular, you are responsible for having a lawful basis to contact every recipient, for the content of every message, and for honouring opt-out requests. You won't use the Service to send spam, to deceive, or to break the law of any country you send to.

The Service applies technical guardrails such as daily caps per mailbox (starting at 50 a day for new mailboxes and 100 a day by default), sending gaps, suppression of addresses that opted out, and checks for unfilled placeholders. These help, but they don't make a campaign lawful or welcome; that remains your responsibility.

6. How we enforce the rules

We don't monitor what you write or read. We act on what our guardrails detect and on reports we receive, and only to keep the Service lawful and safe. What isn't allowed is set out in these terms and the Acceptable Use Policy.

  • Automatic guardrails. Software applies the sending limits in section 5, skips addresses on your suppression list, stops messages with unfilled placeholders, slows a mailbox down when its provider pushes back, and pauses a campaign whose bounce rate gets too high. These checks act on individual sends, mailboxes or campaigns, never on your account as a whole; a paused campaign shows the reason in the app and you can resume it yourself.
  • Decisions about accounts. Limiting your sending caps, pausing campaigns, or suspending or closing an account (section 10) is decided by a person, not by software alone.
  • Reports. Anyone can report illegal content or abuse to abuse@mailpitcher.com, as described in the Acceptable Use Policy. We review every report.
  • Reasons. If we restrict your account or content, we tell you by email what we did, why (the rule and the facts), whether any of it was automated, and how to challenge it, unless the law or an ongoing investigation prevents us.
  • Challenging a decision. Reply to that email or write to hello@mailpitcher.com within six months. A person who wasn't involved in the original decision where possible reviews it, free of charge, and we answer within 14 days. If we got it wrong, we reverse it. You can also use any out-of-court or court route available to you.

7. Your content and data

You keep all rights in your email, contacts, templates and other content ("Your Content"). You give us a limited permission to store, copy, process and transmit Your Content only as needed to provide, secure and support the Service for you, and as described in the Privacy Policy and the Data Processing Addendum.

For personal data inside Your Content (for example your recipients' names and addresses), you are the controller and we process it on your behalf under the Data Processing Addendum, which forms part of these terms. We don't sell Your Content, use it to advertise, or use it to train AI models.

Our staff don't read your messages. Exceptions, which we keep to the minimum needed: when you ask us to for support, when needed to investigate a security incident or a credible abuse report, or when the law requires it.

8. Plans, billing and cancellation

  • Free plan. The demo mailbox, at no cost and with no time limit, to try the inbox and outreach. Connecting your own mailboxes and sending need a paid plan. We may change or end the free plan with 30 days' notice.
  • Paid plans. Solo ($7.99 a month or $79 a year), Pro ($12.99 a month or $129 a year). Plan limits, such as the number of mailboxes, are shown on the pricing page and in the app. If you move to a plan with fewer mailboxes than you have connected, nothing is deleted: the newest mailboxes over the limit stop sending until you remove some or upgrade. Prices are in US dollars.
  • VAT. Prices include VAT where it applies: what you see is what you pay. Businesses with a valid EU VAT number pay the same price with the VAT reverse-charged. At checkout we ask whether you're buying as a business; businesses can give their company name and VAT number, which appear on the invoice.
  • Paid trial. You can try everything in Pro once for 3 days for $1.99 (VAT included where it applies), charged when you start it. During the trial you can connect up to 2 mailboxes and send up to 50 emails a day in total across them, and campaigns pause automatically at a lower bounce rate than usual; everything else in Pro is included, such as the MCP server (what your AI tools send waits for your approval unless you allow otherwise). At checkout you choose the plan the trial becomes: Solo ($7.99 a month) or Pro ($12.99 a month). Unless you cancel, the trial becomes a monthly subscription to that plan at the end of the 3 days, at its price, charged then and every month until you cancel; you agree to this at checkout, and we email you about a day before the trial ends, naming the plan and the amount. You can change the plan the trial becomes in Settings → Plan until the trial ends; nothing is charged for the change, and the plan in place when the trial ends is the one charged. Features of Pro that your chosen plan doesn't include (for example the MCP server on a plan without it) stop when the trial ends, and mailboxes over that plan's limit stop sending, as for any move to a smaller plan. Cancel any time before it ends in Settings → Plan and nothing more is charged; you keep the trial until it ends. You can also start the full plan early in Settings → Plan, which ends the trial and charges the chosen plan's monthly price at once: from then on that plan's own features apply, and the trial's limits lift with that payment. The trial's limits end with the first full monthly payment. One trial per customer: per account, email address and payment card. If we find that the address or card has had a trial before, the trial ends at once and the subscription continues as a normal monthly plan (charged then); we email you, and you can withdraw as described below. The trial is a new subscription: you can withdraw from it within 14 days, and we refund the unused part of the trial price by days (for example, withdrawing after 1 of 3 days gets back 2/3 of it), plus the unused part of any monthly payment made in those 14 days.
  • Renewal. Subscriptions renew automatically for the same period (a month or a year) at the price you agreed to, until you cancel. You agree to this at checkout. Payments are processed by our payment provider (Stripe); we never see your full card number.
  • Reminders. 3 days before each renewal we email you the amount and the card we'll charge; yearly plans also get a reminder 30 days before. If you've cancelled, we email you 3 days before the plan ends instead.
  • Cancelling. Cancel any time in Settings → Plan, online, in a couple of clicks. Once per account we may offer you a discount to stay, which you can simply decline; cancelling is always one click from there. Nothing more is charged; you keep the plan until the end of the period you paid for, and we confirm by email. Until then you can turn renewal back on in the same place. We don't refund partial periods, except where these terms or the law say otherwise.
  • Invoices. Every payment has an invoice, emailed to you and listed in Settings → Plan, where you can view or download it.
  • Price changes. We'll give at least 30 days' notice of a price increase, which applies from your next renewal. You can cancel before it takes effect.
  • Failed payments. If a renewal payment fails, we email you and the app asks you to update your card; your plan stays on for 3 days. If it still hasn't been paid by then, the account moves to the free plan: running campaigns pause and scheduled emails are cancelled. Our payment provider may keep retrying for a while; if a payment then goes through, the plan switches back on.
  • Withdrawal within 14 days. When you buy a new subscription (monthly or yearly), you can withdraw from it within 14 days of paying, without giving a reason. This applies to everyone, businesses included. Before checkout you ask us to start your plan straight away and confirm you know that, if you withdraw, you pay for the days you used; so on withdrawal we refund the unused part of what you paid, worked out by days (for example, withdrawing 4 days into a 30-day month gets back 26/30 of the price). In Settings → Plan, use Cancel or withdraw from contract, then Withdraw from contract (offered during those 14 days), then Confirm withdrawal; or email hello@mailpitcher.com from your account's address, for example: “I withdraw from my Mailpitcher subscription bought on [date] for [account email].” The subscription ends at once, the account returns to the free plan (running campaigns pause, scheduled emails are cancelled), and we confirm by email with what was withdrawn and when. A person reviews the refund, and we pay it to the original payment method within 14 days of your withdrawal, and email you when it's sent. For consumers in the EU/EEA and UK this is your statutory right of withdrawal; paying for the days used follows from your request to start at once (Consumer Rights Directive art. 14(3)). Renewals aren't new purchases and aren't covered, but cancelling before a renewal stops it.

9. Early access

While the Service is invite-only, it may change quickly and some features are marked as previews. We'll try hard to keep it reliable, but early-access features are provided as they are.

10. Suspension and termination

We may limit sending, pause campaigns, or suspend an account, where reasonably necessary and in proportion to the problem, if: you seriously or repeatedly break these terms or the Acceptable Use Policy; your use creates a security risk or harms the Service, our infrastructure or other users (for example the reputation of shared sending infrastructure); or the law requires it. Where we can, we'll tell you why first and give you a chance to fix it. For serious abuse, such as phishing, malware or high complaint rates, we may act immediately.

You may stop using the Service and close your account at any time. We may end the agreement with 30 days' notice (or immediately for serious breach). When your account closes, you have at least 30 days to export what you need, as described in the next section; after that we delete your account data from live systems, and from backups within a further 30 days, except what we must keep by law (for example invoices).

11. Leaving, exporting your data and switching provider

You can take your data with you and move to another service or your own systems at any time. This section sets out your rights under the EU Data Act and applies whatever plan you're on.

  • Asking. You can download a full export yourself at any time in Settings → Account → Download your data. To switch provider with our help, tell us from your account's address at hello@mailpitcher.com. We don't require any notice period: we start when you ask.
  • What you can export. Your account details and settings; mailbox settings and signatures; contacts, lists and custom fields; your suppression list; campaigns with their steps, recipients and send history (status, dates, replies and bounces); templates; project boards with their cards and notes; the files and images you uploaded; and your account's own sign-in and security log. It's self-serve: Settings → Account → Download your data gives you all of it straight away as one ZIP file of JSON and CSV files, and single campaigns and project boards also export to CSV from their own pages. Your mail itself stays with your mail provider, where any other email app can read it; we only keep a working copy, so it isn't in the export. Passwords, sign-in tokens and two-step secrets aren't exported, for security: you set them up again with the new service. Our software and our internal system logs aren't part of your data.
  • Transition period. For up to 30 days after your request, the Service keeps running on your current plan and we help you complete the move. If that's technically impossible, we'll tell you within 14 days, explain why, and propose a longer period (no more than seven months), which you can shorten.
  • No charges. Switching and exporting are free. We don't charge exit or data-transfer fees.
  • After the move. The agreement ends when the switch or export is complete (or at the end of the transition period), unless you tell us you want to keep using the Service. You then have at least 30 more days to retrieve your data, after which we delete it completely, including from backups within a further 30 days, except what the law requires us to keep.
  • Where the Service runs. Our servers and database are in Frankfurt, Germany (EU), with DigitalOcean; outgoing mail connections pass through a relay in Frankfurt with Vultr. Both companies are US-owned. To protect your data against access by a non-EU government that would conflict with EU law, we keep it in the EU, encrypt mailbox credentials and cached message content with keys held apart from the database, and refuse and challenge requests that aren't lawful under EU law. The full list of providers is in the Privacy Policy.

12. Our property

The Service, its software and brand belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the Service during your subscription. Don't copy, resell, reverse-engineer (except where the law allows it) or use the Service to build a competing product. If you send us feedback, we may use it freely.

13. Warranties

We'll provide the Service with reasonable skill and care. Beyond that, and to the extent the law allows, the Service is provided "as is". We don't guarantee that emails will be delivered or land in the inbox, that recipients will reply, or that a mail provider will keep your mailbox active. Deliverability depends on many things outside our control.

14. Liability

  • Neither of us is liable for indirect or consequential loss, or for lost profits, revenue, business or goodwill.
  • Our total liability under this agreement in any 12-month period is limited to the greater of the fees you paid us in that period and 100 euros.
  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that can't be limited by law. Consumers keep any statutory rights that can't be waived.

15. Your responsibility for your sending

If someone brings a claim against us because of email you sent through the Service, or because you broke the Acceptable Use Policy or the law, you'll cover our reasonable costs and losses from that claim. We'll tell you about the claim promptly and let you take part in handling it. This section doesn't apply to consumers.

16. Changes to these terms

We may update these terms. For material changes we'll give at least 30 days' notice by email or in the app, and ask you to accept the new version before you continue using the Service. If you don't agree, you can cancel before the change takes effect and receive a pro-rata refund of any prepaid fees.

17. Law and disputes

These terms are governed by the laws of Latvia. The courts of Riga, Latvia, have jurisdiction, except that consumers may also bring claims in the courts of the country where they live and keep the protection of its mandatory laws. Before going to court, please contact us; most problems are solved faster that way. If you're a consumer and we can't settle a complaint, you can turn to an out-of-court dispute body: in Latvia, the Consumer Dispute Resolution Commission of the Consumer Rights Protection Centre (PTAC), or the equivalent body where you live.

18. Everything else

If a part of these terms is found unenforceable, the rest still applies. Not enforcing a right right away doesn't waive it. You may not transfer this agreement without our consent; we may transfer it to a company that takes over the Service, and we'll tell you if that happens. Neither of us is responsible for delays caused by events beyond reasonable control.
